Welcome to Leo's Jeweler. These Terms of Service ("Terms") govern your use of leosjewellry.com and any purchase you make from it (together, the "Services"), operated by Leo's Jeweler, 6360 Pacific Ave # 5, Stockton, CA 95207, United States. Our store is powered by Shopify. By visiting the Site or purchasing from us, you agree to these Terms and to our Privacy Policy, Shipping Policy, and Refund Policy, which are incorporated by reference. If you do not agree, please do not use the Services.
1. Eligibility and accounts
By using the Services you confirm you are at least the age of majority in your state of residence. You agree that all information you provide — including your email, shipping, and payment details — is accurate, current, and complete, and you are responsible for keeping your account credentials secure and for all activity under your account.
2. Our products
We work to represent every product accurately. Each product page lists that piece's materials, finishes, and details — such as 14K white gold finish or 18K yellow gold finish over stainless steel, cubic zirconia detailing, or a watch's movement and water-resistance rating. Finishes may display slightly differently depending on your screen; small differences in tone between photos and the piece in hand are normal and not a defect. Every piece is made to order; production timelines are set out in our Shipping Policy. Product descriptions and availability may change at any time, and we may limit quantities or discontinue products at our discretion.
3. Personalized items
Where a product allows a custom name, message, engraving, or photo upload, we produce exactly what you enter at checkout — please double-check spelling and image quality before ordering. You confirm that you own or have the right to use any text or photo you upload, that it does not infringe any third party's rights, and that it is not unlawful, hateful, or offensive. We may refuse or cancel (with a full refund) any personalization request that violates these requirements. Personalized items cannot be returned for a change of mind, but are fully covered for damage, defects, or errors on our side, as set out in our Refund Policy.
4. Orders
When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order — for example, where we suspect fraud or where a listing contained an error. Your order is accepted when we confirm it and payment is processed. If we cancel or cannot fulfill an order, we will notify you using the contact details you provided and refund any amount charged. Returns and exchanges are governed solely by our Refund Policy. Purchases are for personal or household use, not for commercial resale.
5. Prices and payment
Prices are shown in U.S. dollars and may change without notice; the price charged is the price displayed at the time you place your order, as confirmed in your order confirmation email. Unless stated otherwise, prices exclude applicable taxes and shipping, which are shown at checkout before you pay. You represent that you are authorized to use the payment method provided.
6. Shipping and delivery
Shipping costs, destinations, and timelines are set out in our Shipping Policy. Delivery dates are estimates; we are not responsible for carrier delays outside our control. Title and risk of loss pass to you upon our transfer of the products to the carrier, except that we will replace or refund orders that are lost in transit, arrive damaged, or are incorrect, as described in our Refund Policy.
7. Intellectual property
All content on the Services — including text, images, graphics, logos, and design — belongs to Leo's Jeweler or its licensors and is protected by U.S. and international intellectual-property laws. You may use the Services for personal, non-commercial purposes only, and may not reproduce, distribute, or create derivative works from our content without prior written consent. Shopify's name and logo are trademarks of Shopify. All other trademarks belong to their respective owners.
8. Relationship with Shopify
Leo's Jeweler is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make in our store are made directly with Leo's Jeweler. By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and Leo's Jeweler, and you release Shopify and its affiliates from claims arising from your purchases and transactions with us.
9. Reviews and feedback
If you submit reviews, suggestions, or other content, you grant us a perpetual, worldwide, royalty-free license to use and display it in connection with the Services. You confirm your submissions are your own, are truthful, disclose any incentive received, and do not violate any third party's rights. We may remove content that is unlawful, offensive, or violates these Terms.
10. Prohibited uses
You may use the Services only for lawful purposes. You must not: violate any law; infringe intellectual-property rights; submit false or misleading information; transmit malware; harvest personal information of others; interfere with the Services' security; or use scraping tools, robots, or automated means to access the Services without our permission. We may suspend or terminate access for violations of these Terms.
11. Errors and inaccuracies
Occasionally, information on the Services may contain typographical errors or inaccuracies relating to descriptions, pricing, promotions, or availability. We reserve the right to correct errors and to cancel affected orders (with a full refund of any amount charged) at any time without prior notice.
12. Disclaimer of warranties
The Services and all products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, Leo's Jeweler, its owners, employees, and service providers, and Shopify and its affiliates, will not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of the Services or products purchased through them. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, or your rights under our Refund Policy.
14. Indemnification
You agree to indemnify and hold harmless Leo's Jeweler and Shopify, and their respective affiliates, officers, and employees, from claims arising out of your breach of these Terms, your violation of any law or third-party right (including rights in personalization content you upload), or your misuse of the Services.
15. Severability; waiver; entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right is not a waiver of it. These Terms, together with the policies referenced in them, are the entire agreement between you and Leo's Jeweler regarding the Services.
16. Governing law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. You and Leo's Jeweler consent to the jurisdiction of the state and federal courts located in San Joaquin County, California.
17. Changes to these Terms
We may update these Terms from time to time by posting the revised version on this page with an updated "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
